Buggy raffles

Seems there is a bunch of drama starting in the jimmy smith buggy raffle about what section its in and if it's legal, blah blah. The fawkers will keep pushing the matter now that the fire seems to be lit. They are already paging admin to the topic.....so I'd assume it will be something needing to be addressed soon with the increase of buggies being raffled.

To me, I don't give a ****. Hardline isn't responsible/liable for anything, there really isn't another section it would fit in besides general discussion, and if it's illegal and buggy winner/seller may owe taxes, then that's up to the seller and winners....not hardline.

What are you guys' thoughts and what sort of rule-base needs to be put in place? Because it seems like the raffle trend is going to continue to grow until someone gets busted legally. Ban them all together? Allow them at poster's own risk? Post raffles to General Discussion only since it's apparently a big deal to some that it is in vehicles for sale and not technically for sale? May just be best to ban raffles of any kind on the forum to avoid being a part of any of it at all.....?

I have been on the fence regarding this topic and have been watching how this has been played out as well as the others. I am not a fan at all of this method, even if it benefits a good cause. On one hand, someone can get a good deal, but on the other, there is so much drama and the possibility of an error with the draw. With that said, John G did not ever have this issue arise that I know of and therefore I have no basis for the answer so I am putting it up for ideas. This by no means is the complete answer, but more or less a barometer for me to make an overall decision by. It will then be put to a poll by myself and the other OG's for the final answer. As much as I like deregulation and freedom to fail or succeed on your own, I can't think of another way to satisfy the masses other than prohibiting listing raffles here. If they weren't illegal it wouldn't be a problem, but even though I doubt HL can be held responsible for any of it, HL (and Facebook) may end up being the vehicle by which the raffles get caught. Esoecially with everybody posting "how is this legal, is this for a nonprofit, is this for 5013c, these are illegal, you must pay taxes on capital gains from raffle, etc", lots of keywords to grab the attention of officials scanning the interwebs for wrongdoings.

I like the idea of them, hell I won $750 in 2nd place on a buggy raffle. But have gotten a bad feeling since that it is only a matter of time before someone gets caught. Especially since everyone is taking payment through PayPal. PayPal watches your accounts closely....wtf do they think when essentially overnight they are having 200+ people depositing $200+ into one single account as a transaction titled "send money to friends and family". It's not a gofundme....and they know that. Lol.

If it's legal, why would anyone care how someone gets rid of something? Now if you bought a raffle ticket and didn't win well you have no grounds to complain because you took a risk and it didn't pan out. Taking into consideration that everything was done like it should be with a raffle where it's not rigged or whatever... So I could care less if someone raffles a buggy or whatever they want to raffle. It's kind of like the lottery if you don't like it don't play. I also haven't looked at the thread you are talking about so maybe I need to do so. But I'm the kind of person that if it doesn't affect me then it really doesn't bother me.

It's illegal unless it is for a nonprifit organization. Raffles are banned outright period in AL and HI if Im not mistaken. It's kinda like making money, talking about it on the internet, and not reporting it to the irs. It's gambling and gambling is illegal amongst regular individuals.

This has been the attitude I have been using since the first raffle with Richie Cheetham came through here. It doesn't affect me, so why should I pay to play? BUT, I am looking our for the best interest of the board and trying to keep the social MED'IDIOTS at bay that keep fueling the dumpster fire.

Yeah I can see that. Geez it just sucks idiots are everywhere.... Good luck with that!
 
I just thought about this too, if it's illegal in AL then how do so many people get away with it? Me and my dad go to a ton of car shows and just about everyone of them have raffles or drawings for prizes...

If its for a non profit, its legal if done right. If its not for non profit like you mention at car shows, it's probably for very little monetary value, not documented, and nobody is gonna catch them. Raffling off a $40k buggy all completely documented on the internet is a lot different than raffling a $250 shotgun or something of the sort at a car show, or by a church (church being non profit). All the ticket buyers' names, seller's name, price per ticket, total ticket amount sold, every single ticket purchase transaction, and the winners, all are completely documented in detail on the interwebs.

It's also illegal to receive rental revenue and not report it when you file your taxes, but I have been extremely surprised how many local landlords I have talked to that admitted not reporting ANY rental revenue despite having multiple properties. Might get away with it for awhile, but eventually **** always catches up to those people.

I 100% am not bothered by the raffles. Thought about buying in on another one. Wouldn't bother me if you came out and stated "post raffles at your own risk" and clarify which section you would like them to be posted in. Then everyone bitching can just shut the **** up or move on. Lol. I generally try to maintain the stance of if it doesn't directly affect me I don't give a ****. But I know deep down, all those bitching would love to see raffles banned here.

I live in TN and for about 10 years of my life I filed taxes as a professional gambler.
The lottery became legal in 2003 and the crackdown was on, how can I gamble and file
taxes in a state where gaming is illegal? (the state wanted to squash competition)

I can tell stories & give examples for days. The powers take it very seriously, I paid
tax on every dollar I won, but was advised against claiming any loss. I've witnessed
several business shutdown for something as simple as a $1 parlay card.

I LOVE to gamble, but would not touch anything as public as an illegal raffle, it's just
too "IN YOUR FACE", kinda like selling meth on craigslist. The powers don't care that
the board is not involved, it is the avenue to the event.

At first it didn't bother me, like a few others have stated, it didn't affect me so I didn't care. Now it is really starting to get on my nerves. It has also turned into an over opinionated bitch fest like half the other threads on this forum.

Shut it down or let it ride, but all of the sidebar in that thread should be cut out IMO.

It also seems that the same few guys pop up in every thread in a poor attempt to "govern" the board which is getting beyond old.

Maybe clean that thread up, start a thread to either condone or bar the raffles (maybe "sticky" it as well) on this forum and be done with it. thumb.gif Just the new guy's 2c.

But....what's the OG's thoughts on all this? Doesn't look like the issue is going away.
