DUI'S and the Army?

So my little brother came home for the weekend and got picked up for DUI not even a couple miles from the house. It was close enough that I was able to ride my bike and bee there within minutes to get his truck so he didn't get it impounded then I had to go get him at the highway patrol office where he blew a .199. He knows he ****ed up and that he shouldn't have been driving but I was just curious if anybody else has any experience with this and the Army, wondering if he's gonna get kicked out or not with a year left on his contract. I understand drinking and driving is really stupid but I don't see a dishonorable discharge as a fair punishment.

I agree it seems a little extreme, but the punishment will probably be based off what could have happened (killed somebody) that what actually happened
 
Your brother can't be the first soldier to get a civilian DUI. I lived close enough to Ft. Benning and knew enough army guys for 14 years to know that SOME of them had to be getting DUI's just by the law of averages. Some of those guys did nothing but party and drive home drunk off their asses. If the Army kicked every soldier out for a DUI we would have to reinstate the draft just to guard the gates to the base.

It will really depend on the CO, but if it is his first DUI I would say he will have to do rehab.

Considering what these guys go through it has to be kind of expected that this **** will happen. I understand it doesn't make it right but I know my brother has visited the bar quite a bit since returning from Afghanistan and he's usually pretty responsible about it so I haven't said much about it. He was a squad leader over there and lost a real close buddy so I figured this kind of his way of handling it.
 
I had several of my soldiers get DUI' . Most of the time they received their punishments from the courts I think it was 48 hours in jail and loss of license for 1 year then the army will give him an article 15 which will result in loseing rank and probably a weeks worth of pay. But it does also depend on his CO as to how hard he wants to be on him. But I've never seen anyone discharged for it.
 
I am currently a Platoon Sergeant in the 82ND ABN DIV and it's our policy to immediately start the chapter process(Kicking out) on any soldier that receives a DUI. It's no longer up to the CO its a Division wide policy. I don't know your location but I'm pretty sure the entire Army is on the same page due to the reduction of force. Where is your brother stationed? What is his MOS?
 
When I was in, my room mate got like 2 drunk in publics and a Dewey before they chaptered him out. I bunked with him for 2 years and I can't remember a time when he wasn't on extra duty and broke as ****. But that was back in '01-ish.

Does his Chain of command know yet? If not tell him to go to ASAP as soon as he return to post and then notify his COC. He may lessen the blow if he's drinking to cope. Also tell him to lawyer up. If he's planning on ETS'ing in less than a year it may buy him some leniency.

He goes back tomorrow and I think he might go talk to JAG. My cousin was a Captain in the Army and that was his recomendation. He's supposed to get out in less than a year but I guess they've also been told they could be getting stop lossed and sent to Iraq. That **** will really piss me off! They pulled that **** on my cousin and I think it's pretty ****ed up.
 
My buddy in the Air Force is on his 3rd Dewey not counting all this times cops let somebody come get him.
 
Had an Army buddy that got one. He lost rank and had to do a lot of pushups, situps, and running. Basically they treated him like he was in boot camp for a week or two and he lost some pay for a year. This was about 6 or so years ago though.

As an MP in the Army stationed at Fort Riley I will tell you he cannot be charged and punished by his Commander AND civilian law. It's one or the other. The Army usually relinquishes punishment to civilian courts if it happens off post. He can and probably will get his driving privileges banned on post for at least a year. Definitely going to have to go through Army Substance Abuse Program training. Depends on post policy/commander is a chapter packet is to be started. He can try and fight the chapter if it happens though.
