Nope not me, just askin for my brother and friend. Anyone done the fleeing/eluding thing? What fines/possible jailtime involved? Any info appreciated.

Fleeing and Eluding in Kansas is a misdemeanor punishable by up to six months in jail (1st offense) and/or a fine of up to $1000. Second offense can result in jail time of up to one year, and/or a $2500 fine.
Fleeing and Eluding is a felony if five (5) or more traffic infractions occur during the pursuit.
Rob- as far as the cop detaining you...he had the right to question you, but you are not under any obligation to answer or talk to him. Obstruction of official duty is defined as:
KSA 21-3808. Obstructing legal process or official duty. (a) Obstructing legal process or official duty is knowingly and intentionally obstructing, resisting or opposing any person authorized by law to serve process in the service or execution or in the attempt to serve or execute any writ, warrant, process or order of a court, or in the discharge of any official duty.
(b) (1) Obstructing legal process or official duty in the case of a felony, or resulting from parole or any authorized disposition for a felony, is a severity level 9, nonperson felony.
(2) Obstructing legal process or official duty in a case of misdemeanor, or resulting from any authorized disposition for a misdemeanor, or a civil case is a class A nonperson misdemeanor.
I don't see the Obstrction in this case.
Not to be an ass here...but if you run from the police...you are a dumb ass. You may outrun the cop, but you can't outrun motorola. Running from the police only puts you, the officer and the other innocent users of the roads at risk. If you are running from the police and get invovled in a crash that results in a serious injury or fatality- you can (and likely will) be charged with Aggravated Battery, Manslaughter, or even Murder. Is that worth it to avoid a traffic ticket?

The cop/deputy told you that you can ride your ATV's on the roadways? Not so- unless they are tagged and insured.

actually had a cop put one of my friends in the ditch one day on his quad.
kid was only 12, cop did pit mauver on him down the road.
long story, kid flew off, compound fracture femur. cop tackles him, pepper sprays him, cuff him and off to jail w. no medical attention..
what did the cop get... not a damn thing.. :![]()
