fleeing and eluding?

Nope not me, just askin for my brother and friend. Anyone done the fleeing/eluding thing? What fines/possible jailtime involved? Any info appreciated.
 
Well it's about time someone got caught... Ya play with fire long enough---you're gonna get burned... I've only ran once(in this town)--and I was on the 110.. My friend Slater has eluded and gotten away with it several times... Luckily, yesterday I was not riding... We usually meet up at my house and go ride around Stilwell.. There's some cool trails back in the woods. Yesterday, my brother and friend Slater take off on their quads---Slater just put a hot cam in his and so they were out to see what it could do. I guess they pass a cop on Metcalf that was headed the opposite direction (the sheriff was actually responding to a noise complaint from my neighbor)... Cop flips a U-eee and hits the cherries.. My brother and slater take off and leave him in the dust. Sheriff rolls up to my house and says "WHERE ARE YOUR FRIENDS?!!" I tell him I don't know what he's talking about and he tells me that I'm going to jail for obstruction of justice, puts me in the car (uncuffed). Long story short an hour and a half later I get outta the car and my brother and Slater turn themselves in. They got 63mph in a 45 speeding ticket and fleeing and eluding... Had they pulled over they would have only spent $143 on the speeding ticket/court fee. Reason I asked on here was I figured between Kelly, P, Miles, Bones and heath, someone has had to have done that or knows someone that got busted.

The sherriff was actually pretty cool after we got to talking to him... He was just majorly pissed that the guys ran... his adrenalin was goin. He actually rides and told us what we could and couldn't do around town. Confirmed it is legal to ride atv's and dirtbikes on the roads---just within speed limit!
 
Really doubt he had the right to put You in the cop car..

Really stand firm on my belief that all cops are douch bags...thats what drives them to go to work everyday...
But who is to say what rights anyone has... People only have the right to do whatever the cop tells them.. assholes...

actually had a cop put one of my friends in the ditch one day on his quad.
kid was only 12, cop did pit mauver on him down the road.
long story, kid flew off, compound fracture femur. cop tackles him, pepper sprays him, cuff him and off to jail w. no medical attention..
what did the cop get... not a damn thing.. ::)

heath ran a year before me, it was a misdemeanor for him, when I did it was a felony, 2 months after my first DUI laughing1 I were smart when I were 19 laughing1
 
When I was 14 I used to ride my dirtbike all over the place and one day I had the local Police Helicopter chase me down and call a squad car to escort me home. Cop talked to my mom and let me go with a warning. I have been brought home by the cops a few times on my dirtbike. I never ran and they never really got on to me. Just told me to stay off the main roads.

My last week in college me and some friends were leaving the bar and flying home of course, a cop passed and turned around. After chasing us down to the apartment (luckily I was't driving) and threw the driver in cuffs. About 5 squad cars showed up and tried getting the rest of us to exit the vehicle. While I was in the car I called my Lawyer friend and he told me not to get out whatever I do... b/c then you become their responsibility and after a chase they're throwing everyone in jail. Every cop came by and tried lying to us to get out, we told'em all to F'off ... Finally they left. The driver ended up with the same charges and DUI, but my layer friend got it down to nothing :****:

I've been searching online and it looks like a class B nonperson misdemeanor... If it were a felony, wouldn't he not have just been let off with a traffic ticket? Owell he'll see when he goes to court on July 2nd... Damn my brother's neeeever been in trouble before molaugh
 
How the **** do you get caught on a quad? :flipgotcha: We did that **** in GB all of the time. Gotta know the hiding spots and escape routes. :****: Hell, one of my buddies crashed his 3-wheeler while running. So he got up and ran to the nearest friend's house, called his wife and told her to report the 3-wheeler stolen. It worked. Cops assumed someone else stole it and he got off with nothing. :flipoff1:

Still can't believe he put you in the car for obstruction of justice. How did he know that you knew them?
 
Never got even remotely close to caught on dirtbikes in Springhill.


Have ran a few times on street bikes but stopped doing that when my buddy Rob got popped. All I know from that was it cost him a ton of money , and he was on probation for 1yr.

Rob, sounds like you have a neighbor thats tired of ya'll riding . laughing1
 
Bones? How'd I get into this? I stop when I see cherries. Just got another, likely loose my license for 6 mo if I can't get it reduced to a non moving (got it in MO 3 miles from the IA border)

Fleeing and Eluding in Kansas is a misdemeanor punishable by up to six months in jail (1st offense) and/or a fine of up to $1000. Second offense can result in jail time of up to one year, and/or a $2500 fine.

Fleeing and Eluding is a felony if five (5) or more traffic infractions occur during the pursuit.

Rob- as far as the cop detaining you...he had the right to question you, but you are not under any obligation to answer or talk to him. Obstruction of official duty is defined as:

KSA 21-3808. Obstructing legal process or official duty. (a) Obstructing legal process or official duty is knowingly and intentionally obstructing, resisting or opposing any person authorized by law to serve process in the service or execution or in the attempt to serve or execute any writ, warrant, process or order of a court, or in the discharge of any official duty.

(b) (1) Obstructing legal process or official duty in the case of a felony, or resulting from parole or any authorized disposition for a felony, is a severity level 9, nonperson felony.

(2) Obstructing legal process or official duty in a case of misdemeanor, or resulting from any authorized disposition for a misdemeanor, or a civil case is a class A nonperson misdemeanor.



I don't see the Obstrction in this case.

Not to be an ass here...but if you run from the police...you are a dumb ass. You may outrun the cop, but you can't outrun motorola. Running from the police only puts you, the officer and the other innocent users of the roads at risk. If you are running from the police and get invovled in a crash that results in a serious injury or fatality- you can (and likely will) be charged with Aggravated Battery, Manslaughter, or even Murder. Is that worth it to avoid a traffic ticket?

The cop/deputy told you that you can ride your ATV's on the roadways? Not so- unless they are tagged and insured.

They caught em on quads because the sherriff was en route to my house and had neighbor witness the guys leaving my place. Pretty easy to get caught when they know where you came from.

Thanks for replying. He used obstruction to scare me I guess?? He told me to get in the car so I did as told. I was trying to be respectful, but he hauled ass up into my driveway, ran at us and started yelling in my face so I guess I had a smirk on my face. I had no idea wtf was going on!

When I ran on my 110, we were in some trails back in the woods where you have to cross 50-100 feet of railroad property, we got up to the road---saw the sherriff deputy waiting for us and bounced 5 miles down the tracks to the county line. Dumb, yes but seemed like a good idea at the time. That's the only time we've ran is head south on the railroad tracks to the next county---not exactly something that can result in murder, fatalities, etc. Not justifying a dipshit maneuver---just saying, it was not hauling ass through a residential neighborhood.

He did tell us it is okay to ride ATV's on the roadway---just said that we would need to make sure that we ride within the limits of the law (speed, not being reckless, etc.) See exerpt below:

8-1402a. "All-terrain vehicle" defined. "All-terrain vehicle" means any motorized nonhighway vehicle 48 inches or less in width, having a dry weight of 1,000 pounds or less, traveling on three or more low-pressure tires, having a seat designed to be straddled by the operator. As used in this section, "low-pressure tire" means any pneumatic tire six inches or more in width, designed for use on wheels with rim diameter of 12 inches or less and utilizing an operating pressure of 10 pounds per square inch or less as recommended by the vehicle manufacturer.

Registration:
Exempt from registration in 8-128. Registration of vehicles, exceptions.

Insurance:

Synopsis:
• Private citizens shall not operate an ATV on any interstate, federal or state highway; not even incidental movement.
• The City of Ottawa prohibits the operation of ATVs anywhere within the city limits either on private of public property.
• The county, KDOT or persons contracting with the government to eradicate weeds may operate an ATV along the right-of-way of federal and state highways, and incidentally operate upon such highways.
8-15,100. Operation of all-terrain vehicles; where; when; exceptions. (a) Except as provided in subsection (b), it shall be unlawful for any person to operate an all-terrain vehicle: (1) On any interstate highway, federal highway or state highway; or (2) within the corporate limits of any city unless authorized by such city.
(b) Notwithstanding the provisions of subsection (a), all-terrain vehicles owned and operated by a county noxious weed department, or all-terrain vehicles owned and operated by persons contracting with a county noxious weed department or the Kansas department of transportation may be allowed to operate such all-terrain vehicles upon the right-of-way of any federal highway or state highway for the purpose of eradicating noxious weeds and such all-terrain vehicles may be operated incidentally upon such federal highway or state highway.

(d) This section shall be part of and supplemental to the uniform act regulating traffic on highways.

You know there are a couple of cops on this board, and not all cops are ass holes. So saying all cops are douch bags aint real ****ing smart. Go strap a gun on, put on a bullet proof vest, deal with assholes all day, kick in the door of a couple crack houses, take momma and daddy to jail for a domestic while the kids are crying, get in a few car chases, get into a fight with some one on meth, then you can talk ****. I'm no bitching about my job, I chose to do it and enjoy it, but I bet you don't know a damn thing about what I do every day. I also bet that you might talk **** right now, but let someone start beating your ass, or some jacks your car, or crack head breaks into your house, or some shoots at your, or you get ass raped, I sure as hell bet then you will be wanting the cops there. And anyone who runs from the cops is ****ing stupid.
