okay, got my nv4500 rebuilt by transgear. an exchange, actually. after 300 miles with the recommended oil ($110) and proper break in, the main shaft breaks. I don't see this being the case, but they said it broke. My truck still drove in 1st and 2nd and reverse strong. He said there was no way it would, even though I drove it for 2 days like this. so whatever. anyway, it started making noise well before this happened. there was a warranty on it. I sent it back and they put a new mainshaft in it. to the tune of $180 for the part. Happy enough. I say, ver batim "okay, so this is on my debit card, how much are you charging me". he says, "$180" I put that much in my paypal account from my regular account. I check the next day, they charged me $270. I have an overdraft charge. I transfer teh money to cover that and the charge and call my mom at teh bank. no problem on the charge, she refunds it, I covered it before anyone else caught it. anyway, I call and say wtf in a very nice tone. He says its to cover my half of the shipping. Fair enough I say, $90 is doable, lets get that thing back in.

Okay, fast forward. I get a overdue notice from UPS freight 2 months ago. says I'm overdue on a $370 ****ing shipping bill. I call them immediately and he says its a mixup and he has it covered. not to worry, it was billed to me on accident and he has it. Okay, there is probably where I ****ed up. I should have followed up with UPS or recorded that phone call or something. Today I got another overdue notice from UPS. Now this could be affecting my credit, 5 months overdue. He billed it to me on "accident" so he said. No answer today so it'll have to wait til tuesday. I did leave a very lengthy and informative voice mail for him. we'll see how this turns out, but they are in Indy, IN. that is 1.5 hrs from attica, and his shop is right off I 70. lets say he tells me to pack sand. wonder what I can do without going to jail at his shop that's worth the $90+ the $370 he is trying to **** me out of? $500 worth of damage gets me nowhere. $500 worth of assbeating doesn't either. I need something to take back. stealig could make it worse.
now what. I have yet to get ahold of them. He might pay it on the spot. If not that comes out of my **** now. I don't really "have" that money. nor really at all to spare. No bama if I have to. ****.
anyway, please advise.
 
That is shady as ****. But he may have legitamately made a mistake, but he couldnt have possibly forgot to fix it when yuo called him. I'd talk on Tuesday, after that PENDING conversation send him a registered letter with an Invoice for the charges and damages. If he doesnt respond, file a small claims in Paola as thats where the item was shipped and UPS is invoicing you. Dude wont show up, so you'll get judgement. You'll probably never get paid. Or he may settle with ya.

I would also follow up with UPS, and notify them of the situation. That the shipment that you are being billed for was not to be billed to the reciept point but the shipper. They probably wont help you, but get them to note that on the invoice bill they currently have outstanding. Do you have the guys UPS account #? he shipped to you before correct? I'd give that to UPS as well.

I'm not sure how a shipper can send you something on your dime without your consent or shipping account #.
 
agreed. I don't have a shipping account or #, so how do they bill me? I need to get UPS CS on the horn and have them note that. I'm just frustrated with this guy when it ****ed up immediately (making noise after 200 miles, broken shaft at 300 with no undue force on it). He says he's only seen truck pullers break main shafts.......with like 700 horse. My clutch is rated to 400 and I coulnd't blow through it laughing1 I wasn't overpowering. anyway, he got real shady when I called asking warranty questions.

I wonder if the better business bureau or threats of reporting to the BBB would inspire him to get it taken care of?

Guy in our club broke 2 or 3 nv 4500's, I was ridding with him (tow rig) when the first broke going uphill on a windy 2 lane about 30 min outside of Harlan (homebound, year ago this weekend)Pretty fun being towed behind a cab truck on 42's in a dually with a trailer, through a license check :spin:

After that, he bought a 5600 6 speed. First one lasted a month or so, second one about a week, third one didn't make it past it's first trip. I know he was in for about $4000 (lots of $$$$$$$$ oil, 3 cluthes) just on the 6 speeds, ****er did not want to give his money back after the second one craped out. He told the guy he wolud spend whatever it took to make his life/business a living hell, finally got $2000 back IIRC about a month ago.

Now he has a ZF 6 speed out of a ford.
 
gawd I hope my 5600 doesn't give up. I'm just pissed that he didn't say in the first place he was going to charge for the shipping. He told me EXPLICITLY on the phone that my part would be $180. then I get charged $270......"oh, that's your part of the shipping." I shouldn't have let it go there, but I wanted the tranny back and my ****ing truck on the road. If I know up front its going to be this much, I can plan for it or tell him to **** off. Not dropping surprises on me after lies ::)

Mafia, was it from transgear or another shop?

Similar thing happened to me. I bought a compressor off ebay. The shipping freight company I used setup everything on the shipping end. I went down to the terminal to pic it up and they wanted to charge me $250 dallors more for shipping. I'm like bull ****, I didn't arrange any of the shipping I'm not liable I'm not paying. well I kept stalling with the shipping company, saying I'm not going to pay , but finally had to. I made them set me up on payment plans. Then I drug it out as long as possible, plus I made sure everyone on all ends new how I felt.

The BBB is a scam They call me all the time wanting me to join their group, I would say about every six months. Their line is "we've been getting alot of inquiries about your company but can't give out any info because your not a member". If you call the BBB about a problem you've had with a buisness they have to have soooo many complaint before they list them as a bad company. Plus remeber the companies are paying the BBB to give them help and support to resolve thier disputes. Why would the BBB piss off a paying company? they want.
